s. 1 — Definition

In this regulation, Act means the Workers Compensation Act.

s. 2 — Prescribed occupational diseases

Each of the following is prescribed as an occupational disease for the purposes of section 140 (1) (b) [firefighters: presumptions respecting lung cancer and other diseases] of the Act:

s. 2(a)

primary leukemia;

s. 2(b)

primary non-Hodgkin's lymphoma;

s. 2(c)

primary site bladder cancer;

s. 2(d)

primary site brain cancer;

s. 2(e)

primary site colorectal cancer;

s. 2(f)

primary site kidney cancer;

s. 2(g)

primary site testicular cancer;

s. 2(h)

primary site ureter cancer;

s. 2(i)

primary site esophageal cancer;

s. 2(j)

primary site breast cancer;

s. 2(k)

primary site prostate cancer;

s. 2(l)

multiple myeloma;

s. 2(m)

primary site ovarian cancer;

s. 2(n)

primary site cervical cancer;

s. 2(o)

primary site penile cancer;

s. 2(p)

primary site pancreatic cancer;

s. 2(q)

primary site thyroid cancer;

s. 2(r)

primary site skin cancer;

s. 2(s)

primary site laryngeal cancer;

s. 2(t)

mesothelioma;

s. 2(u)

soft tissue sarcoma;

s. 2(v)

primary site tracheal cancer;

s. 2(w)

primary site bronchial cancer;

s. 2(x)

primary site nose cancer;

s. 2(y)

primary site pharynx cancer.

s. 3 — Minimum cumulative periods of employment prescribed

The minimum cumulative period set out in Column 2 of the Table is prescribed for the purposes of section 140 (2) (a) of the Act in respect of the occupational disease set out opposite it in Column 1. Table

s. 4 — Minimum non-smoking periods prescribed for previous smokers

In the case of a worker who does not meet the requirement of section 140 (3) (a) of the Act, the minimum period for the purposes of section 140 (3) (b) of the Act is prescribed as follows:

s. 4(a)

if the worker smoked cigarettes,

s. 4(a)(i)

6 consecutive years, if the worker smoked, on average, fewer than 7 cigarettes per week,

s. 4(a)(ii)

6 consecutive years, if the worker smoked, on average, 1 to 9 cigarettes per day,

s. 4(a)(iii)

13 consecutive years, if the worker smoked, on average, 10 to 19 cigarettes per day,

s. 4(a)(iv)

18 consecutive years, if the worker smoked, on average, 20 cigarettes per day,

s. 4(a)(v)

23 consecutive years, if the worker smoked, on average, 21 to 39 cigarettes per day, and

s. 4(a)(vi)

28 consecutive years, if the worker smoked, on average, 40 or more cigarettes per day;

s. 4(b)

8 consecutive years, if the worker smoked, on average, one or more cigars or pipes per day but did not smoke cigarettes;

s. 4(c)

if the worker smoked cigarettes in combination with cigars or pipes, the periods prescribed in paragraph (a) apply with a cigar or pipe counting as a cigarette.
