137_2019 — Family Member Regulation

s. 1 — Definition

In this regulation, Act means the Employment Standards Act.

s. 2 — Prescribed classes of individuals — "family member"

The following classes of individuals are prescribed for the purposes of sections 52.1 (1) (b) [compassionate care leave] and 52.11 (1) (b) [critical illness or injury leave] of the Act:

s. 2(a)

in relation to an employee,

s. 2(a)(i)

a step-sibling,

s. 2(a)(ii)

a parent's sibling,

s. 2(a)(iii)

a child of a sibling,

s. 2(a)(iv)

a current or former foster parent,

s. 2(a)(v)

a current or former foster child,

s. 2(a)(vi)

a current or former ward,

s. 2(a)(vii)

a former guardian, or

s. 2(a)(viii)

the spouse of

s. 2(a)(viii)(A)

a sibling or step-sibling,

s. 2(a)(viii)(B)

a child or stepchild,

s. 2(a)(viii)(C)

a parent,

s. 2(a)(viii)(D)

a grandparent,

s. 2(a)(viii)(E)

a grandchild,

s. 2(a)(viii)(F)

a parent's sibling,

s. 2(a)(viii)(G)

a child of a sibling,

s. 2(a)(viii)(H)

a current or former foster child, or

s. 2(a)(viii)(I)

a current or former guardian;

s. 2(b)

in relation to the employee's spouse,

s. 2(b)(i)

a step-parent,

s. 2(b)(ii)

a sibling or step-sibling,

s. 2(b)(iii)

a grandparent,

s. 2(b)(iv)

a grandchild,

s. 2(b)(v)

a parent's sibling,

s. 2(b)(vi)

a child of a sibling,

s. 2(b)(vii)

a current or former foster parent, or

s. 2(b)(viii)

a current or former ward;

s. 2(c)

whether or not related to an employee by blood, adoption, marriage or common law partnership, an individual with a serious medical condition, as described in section 52.1 (2) or 52.11 (4) of the Act, who considers the employee to be, or whom the employee considers to be, like a close relative.
