General

s. 1 — Definitions

In this regulation:

s. 1 — Act

Act means the Post-Secondary International Education (Designated Institutions) Act;

s. 1 — National Occupational Classification

National Occupational Classification means the National Occupational Classification developed by Employment and Social Development Canada and Statistics Canada and their successors, as amended from time to time;

s. 1 — theological institution

theological institution means an institution that offers either of the following:

s. 1(a)

a diploma or certificate relating to an occupation described in the current edition of the National Occupational Classification as follows:

s. 1(a)(i)

41302 (religious leaders);

s. 1(a)(ii)

42204 (religion workers);

s. 1(b)

a degree in theology.

s. 2 — Advertising prohibition — minimum duration of program of instruction

For the purposes of section 2 (a) of the Act, an institution must not advertise a program of instruction of a duration that exceeds 6 months.

s. 3 — Eligible institutions

For the purposes of section 3 (a) (iv) of the Act, the following institutions are prescribed:

s. 3(a)

an institution that is a theological institution;

s. 3(b)

an institution that offers educational programs referred to in section 31 (1) of the Chartered Professional Accountants Act;

s. 3(c)

an institution that offers training for an occupation of driving motor vehicles that requires a driver to hold a Class 1, 2 or 3 driver's licence under the Motor Vehicle Act;

s. 3(d)

Lester B. Pearson College of the Pacific and United World Colleges (Canada) Inc.

s. 4 — Application deadlines

For the purposes of section 4 (2) (d) of the Act, an application for the renewal of a designation certificate must be submitted by the following deadline each year:

s. 4(a)

if the institution is an institution described in section 3 (a) (i) or (ii) of the Act, April 30;

s. 4(b)

if paragraph (a) does not apply and the institution is an institution described in section 3 (a) (iii) of the Act, the date that is the last day of the month following the month in which the designation certificate of the institution under the Private Training Act is issued;

s. 4(c)

if paragraphs (a) and (b) do not apply and the institution is an institution referred to in section 3 of this regulation, October 31.

s. 5 — Term of designation certificate

For the purposes of section 7 (1) of the Act, the prescribed term of a designation certificate is one year beginning on the date it is issued.

s. 6 — Online directory

s. 6(1)

The directory established under section 9 (1) of the Act must include the following information:

s. 6(1)(a)

in relation to a designated institution,

s. 6(1)(a)(i)

the legal name of the institution and any operating name the institution uses,

s. 6(1)(a)(ii)

any former legal name or operating name the institution has held or used in the 5 years preceding the issuance or renewal of the designation certificate held by the institution,

s. 6(1)(a)(iii)

the address of the location where the institution provides a program of instruction, and

s. 6(1)(a)(iv)

the website address for the institution;

s. 6(1)(b)

in relation to a former designated institution,

s. 6(1)(b)(i)

the legal name of the institution and any operating name the institution uses, and

s. 6(1)(b)(ii)

any former legal name or operating name the institution has held or used in the 5 years preceding the issuance or renewal of the last designation certificate held by the institution.

s. 6(2)

In addition to the information described in subsection (1), the administrator may publish in the directory the information described in section 9 (2) (a) and (b) of the Act.
