187_96 — Fines Enforcement Regulation

s. 1 — Definitions

In this regulation:

s. 1 — Act

Act means the Offence Act;

s. 1 — Yuułuʔiłʔatḥ

Yuułuʔiłʔatḥ means the Ucluelet First Nation as defined in section 29.1.1 of the Maa-nulth First Nations Final Agreement.

s. 2 — Designated persons

s. 2(1)

For the purposes of section 132 (2) (f) of the Act, the following persons and classes of persons are designated for the purpose of filing certificates under section 82 (6) of the Act respecting fines, victim surcharge levies and ticketed amounts payable to the government, a municipality or a regional district:

s. 2(1)(a)

prosecutors;

s. 2(1)(b)

municipalities incorporated under the Municipal Act, the Vancouver Charter or the Resort Municipality of Whistler Act;

s. 2(1)(c)

regional districts incorporated under the Municipal Act;

s. 2(1)(d)

the Manager, Customer Collections, Finance Division, Insurance Corporation of British Columbia;

s. 2(1)(e)

the Manager, Fines Collection, Customer Collections, Finance Division, Insurance Corporation of British Columbia;

s. 2(1)(f)

the Manager, Support Operations, Customer Collections, Finance Division, Insurance Corporation of British Columbia;

s. 2(1)(g)

Collection Officers, Fines Collection, Customer Collections, Finance Division, Insurance Corporation of British Columbia;

s. 2(1)(h)

Paralegal Coordinators, Support Operations, Customer Collections, Finance Division, Insurance Corporation of British Columbia.

s. 2(2)

For the purposes of section 132 (2) (f) of the Act, the following persons are designated for the purpose of filing certificates under section 82 (6) of the Act respecting fines and ticketed amounts payable to the treaty first nation:

s. 2(2)(a)

Tsawwassen First Nation;

s. 2(2)(b)

Huu-ay-aht First Nations;

s. 2(2)(c)

Ka:'yu:'k't'h' /Che:k'tles7et'h' First Nations;

s. 2(2)(d)

Toquaht Nation;

s. 2(2)(e)

Uchucklesaht Tribe;

s. 2(2)(f)

Yuułuʔiłʔatḥ;

s. 2(2)(g)

Tla'amin Nation.

s. 3 — Forms of certificates

For the purposes of section 82 (6) of the Act, the following certificates are prescribed:

s. 3(a)

the certificate respecting fines, victim surcharge levies and ticketed amounts payable to the government, a municipality or a regional district is the certificate attached as Appendix A;

s. 3(b)

the certificate respecting fines and ticketed amounts payable to a treaty first nation is the certificate attached as Appendix B.
