In this regulation:
Act means the Utilities Commission Act;
Apollo Transmission System means the transmission system owned by Apollo Forest Products Ltd. on the date this regulation comes into force;
biomass fuel processing project means the project to construct and operate a biomass fuel processing, screening and handling facility located adjacent to the biomass thermal generation facility;
biomass thermal generation facility means the 40 MW biomass thermal generation facility approximately 6 km north of the authority's Fort St. James No. 2 Substation.
Apollo Forest Products Ltd. and its successors and assigns are exempt from Part 3 of the Act in respect of
the Apollo Transmission System,
the provision of service respecting the transmission of electricity from the biomass thermal generation facility to the authority's transmission system, and
the provision of service respecting the transmission of electricity from the authority's transmission system to the biomass fuel processing project.
