28_98 — Court Order Enforcement Exemption Regulation

s. 1 — Definition

In this regulation:

s. 1 — Act

Act means the Court Order Enforcement Act;

s. 1 — maintenance debtor

maintenance debtor has the same meaning as "debtor" in section 1 (1) of the Family Maintenance Enforcement Act.

s. 2 — Exemptions for personal property of debtor

For the purposes of section 71 (1) of the Act, the prescribed amounts of exemption are as follows:

s. 2(a)

$4 000 for household furnishings and appliances;

s. 2(b)

$5 000 for one motor vehicle if the debtor is not a maintenance debtor;

s. 2(c)

$2 000 for one motor vehicle if the debtor is a maintenance debtor;

s. 2(d)

$10 000 for tools and other personal property of the debtor that are used by the debtor to earn income from the debtor's occupation.

s. 3 — Exemption for principal residence of debtor

For the purposes of section 71.1 (1) of the Act, the prescribed amount of equity is as follows:

s. 3(a)

$12 000 if the debtor is a person whose principal residence is located within the boundaries of the Capital Regional District or the Metro Vancouver Regional District;

s. 3(b)

$9 000 if the debtor is a person whose principal residence is located outside the boundaries of the Capital Regional District or the Metro Vancouver Regional District.
