— Definition
In this regulation:
s. 1
— Act
Act means the Unclaimed Property Act;
s. 1
— judicial officer
judicial officer means,
s. 1(a)
in the case of funds in the Court of Appeal, a justice or registrar,
s. 1(b)
in the case of funds in the Supreme Court, a judge, associate judge or registrar, and
s. 1(c)
in the case of funds in the Provincial Court, a judge or registrar.
s. 2
— Court funds
For the purposes of the Act, unclaimed court funds means funds, other than judicial interim release funds, that have been paid into court in a proceeding and that
s. 2(a)
have remained in court for at least 5 years, and
s. 2(b)
have been determined by a judicial officer for that court to be unclaimed court funds.
