52_2012 — Class Size and Compensation Regulation

s. 1 — Definitions

s. 1(1)

In this regulation:

s. 1(1) — Act

Act means the School Act;

s. 1(1) — class

class means a group of students scheduled to be together at least twice a week with a teacher for the purposes of engaging in an educational program;

s. 1(1) — eligible teacher

eligible teacher means a teacher who, in a year in which additional compensation under section 4 may be provided, is not in a category of teachers prescribed under section 3.

s. 1(2)

For the purposes of section 76.1 (2) of the Act:

s. 1(2) — grades 1 to 3

grades 1 to 3 means a class containing students in those grades and includes a class containing students in those grades and in any other grade except kindergarten;

s. 1(2) — kindergarten

kindergarten means a class containing kindergarten students and includes a class containing kindergarten students and students in any other grade.

s. 2 — Classes not subject to 30-student limit

The following categories of classes are prescribed for the purposes of section 76.1 (2.1) (b) of the Act:

s. 2(a)

an adult or continuing education class;

s. 2(b)

a class conducted by means of online learning;

s. 2(c)

a class that is part of an alternate program;

s. 2(d)

a class that meets for the purpose of a work study or work experience program;

s. 2(e)

a class that is limited to students enrolled in a specialty academy, as defined in section 82.1 (1) of the Act;

s. 2(f)

a music class, including band, choir, instrumental music and orchestra;

s. 2(g)

a performing arts class, including drama and dance;

s. 2(h)

a Planning 10 class;

s. 2(i)

a board-authorized leadership course.

s. 3 — Ineligible teachers

The following categories of teachers are prescribed for the purposes of section 76.1 (2.3) of the Act:

s. 3(a)

teachers on call;

s. 3(b)

teachers on a term appointment of less than one calendar month.

s. 4 — Additional compensation

The additional compensation that, under section 76.1 (2.2) of the Act, a board must provide to an eligible teacher is the compensation set out for that purpose in the Memorandum of Agreement entered into by the British Columbia Teachers' Federation, the British Columbia Public School Employers' Association and the Ministry of Education on March 9, 2017.
