English version of the judgment of the Court delivered orally by

Lamer C.J.

Lamer C.J.‑‑ We are all of the view that this appeal should be allowed, essentially for the reasons given by Chouinard J.A. of the Quebec Court of Appeal.
The appeal is allowed, the judgments of the Court of Appeal and the Superior Court are set aside, and the motion to dismiss is dismissed, the whole with costs throughout.
Judgment accordingly.
Solicitors for the appellant: Alepin, Gauthier, Laval.
Solicitors for the respondent: Jean‑Yves Bernard and Françoise Saint‑Martin, Ste‑Foy.
