Judgment of the Municipal Court reversed and new trial ordered, costs to abide the event, on the authority of Barnett v. Brooklyn Heights R. R. Co. ( 53 App. Div. 432 ) and People v. Brooklyn Heights R. R. Co. ( 187 N. Y. 48 ). Jenks, Hooker, Gaynor, Rich and Miller, JJ., concurred. •
