Appeal from an order denying a motion to vacate an order for the examination of a party before trial.

The order appealed from should be reversed, without costs, and the order for the examination of the defendant modified by striking therefrom subdivisions 8 and 9 as to the matters upon which the defendant is required to be examined- Present — Ingraham, McLaughlin, Clarke, Houghton and Scott, JJ. Order reversed, without costs, and order for examination of defendant modified as stated in memorandum. Settle order on notice.
