Order affirmed, with ten dollars costs and disbursements. Ho opinion. Ingraham and Laughlin, jj., dissenting on the ground that under the answer of the executor the surrogate had no jurisdiction to determine the question presented.' (Fiester v. Shepard, 92 N.
