Appeal from an order entered on the 10th day of December, 1909, granting the plaintiff's motion for alimony and counsel fee.

We think, upon the undisputed facts, the court had no jurisdiction of the subject-matter of the action, and, therefore, the order for alimony and counsel fee should not have been granted. The order is reversed and the motion denied. Present — Ingraham, P. J., Laughlin, Clarke, Scott and Miller, JJ. Order reversed and motion denied.
