Headnote

Appeal from an order of the Supreme Court, entered.in the New York county clerk’s office on the 5th day of November, 1915, overruling demurrers to the first, second, third, fourth and fifth separate defenses and the sixth partial defense contained in the defendant’s amended answer.

Each of the defenses contains denials of material allegations of the complaint. The order appealed from should, therefore, be affirmed, with ten dollars costs and disbursements. Present — Clarke, P. J., Laughlin, Scott, Smith and Page, JJ. Order affirmed, with ten dollars costs and disbursements.
