John B. Jemmott, Respondent, v. Christian Mission of the United States of America, Inc., and Others, etc., Appellants.

The evidence at the trial justified the finding of the justice that defendants had obtained possession of the premises by force, and this proceeding is authorized by Civil Practice Act, section 1412. The finding of the Municipal Court has been affirmed by the Appellate Term, and no reason is shown for continuing the litigation. The application for leave to appeal to the Appellate Division is denied, with ten dollars costs.
