Judgment reversed upon the facts, and new trial granted, with costs to appellant to abide the event, unless, within ten days after the entry of the order herein, plaintiff shall stipulate that the recovery of damages be reduced to $3,500, with appropriate costs. In the event of such stipulation, the judgment as so reduced is unanimously affirmed, without costs. Kelly, P. J., Manning, Young, Kapper and Lazansky, JJ., concur.
