Judgment and order reversed upon the law and the facts and new trial granted, costs to appellants to abide the event. The Statute of Frauds is a defense to the first cause of action. The second cause of action was not submitted to the jury, and that it may be submitted a new trial is directed. Lazansky, P. J., Young, Kapper, Seeger and Carswell, JJ., concur.
