Majority

p. 862
Albert Conway, Superintendent of Insurance of the State of New York, as Liquidator of the Empire State Mutual Insurance Company, Appellant, v. Jack Schoenbaum, Respondent.

Order reversed on the law and the facts, with ten dollars costs and disbursements, and motion denied, with ten dollars costs, on the ground that change of the place of trial from the county of Albany to the county of New York would not promote the ends of justice. All concur.
