Margaret Kelly, as Committee of William Kelly, Amended to Read John H. Gamaldi, as Committee of William Kelly, Respondent, v. Isaac Kleinman, Appellant.

Plaintiff, as committee, brought a negligence action to recover damages for personal injuries sustained by the incompetent when he was struck by a taxicab owned and operated by the defendant. Plaintiff had a verdict based u,pon the incompetent’s freedom from contributory negligence and defendant’s negligence. Judgment unanimously affirmed, with costs. No opinion. Present — Lazansky, P.
