The People of the State of New York ex rel. Eli Hershkowitz, Appellant, against V. C. Branham, as Superintendent of Woodbourne Institution for Defective Delinquents, Respondent.
Relator has appealed from an order of the Sullivan County Special Term of the Supreme Court dismissing a writ of habeas corpus and remanding him to the custody of the Superintendent of Woodbourne Institution for Defective Delinquents. The Special Term held that relator is a mental defective and not fit to be discharged from custody. The proof sustains that finding. Order affirmed, without costs. All concur.
