Order affirmed, with $10 costs and disbursements. No opinion. Carswell, Johnston and Adel, JJ., concur; Hagarty, Acting P. J., concurs but adheres to his views expressed in Joehl v. Tricarico (ante, p. 898); Nolan, J., dissents and votes to reverse and to grant the motion.
