In the Matter of David S. Cushman, Petitioner, against Arthur W. Wallander, as Police Commissioner of the City of New York, Respondent.

Upon examination of this record and the evidence adduced at the hearing before the third deputy commissioner of police we find that there is no evidence sustaining the determination that petitioner was guilty as charged. Johnston, Acting P. J., Adel, Sneed, Wenzel and MacCrate, JJ., concur.
