Judgment
The contention of defendant that he was deprived of his right to testify before the Grand Jury has not been preserved for our review (see, CPL 190.50 [5] [c]), and we decline to exercise our power to reach that contention as a matter of discretion in the interest of justice (see, CPL 470.15 [6] [a]; People v Maldonado, 176 AD2d 586 ). The record does not support defendant’s contention that the prosecutor used perjured testimony of a police officer to secure the indictment. The alleged discrepancies in the testimony of the officer do not support the allegation that he perjured himself either before the Grand Jury or at trial. (Appeal from Judgment of Supreme Court, Monroe County, Mark, J. — Assault, 2nd Degree.) Present — Green, J. P., Law-ton, Callahan, Balio and Fallon, JJ.
