Judgment of the County Court, Nassau County, rendered February 6, 1979, affirmed (see People v Haymes, 34 NY2d 639 ; People v Mitchell, 71 AD2d 609 ). This case is remitted to the County Court, Nassau County, for further proceedings pursuant to CPL 460.50 (subd 5). Gibbons, J. P., Rabin, Gulotta and Cohalan, JJ., concur.
