Majority
In an action, inter alia, to recover damages for breach of fiduciary duty, (1) the plaintiffs appeal from so much of an order of the Supreme
Ordered that the appeal and cross appeal from the order entered January 11, 2013, and the appeal from the order entered February 28, 2013, are dismissed, without costs or disbursements.
The appeal and cross appeal from the order entered January 11, 2013, and the appeal from the order entered February 28, 2013, must be dismissed because the right of direct appeal therefrom terminated with the entry of a judgment in the action (see Matter of Aho, 39 NY2d 241 , 248 [1976]). The issues raised on the appeals and the cross appeal from the orders are brought up for review and have been considered on the companion appeal from the judgment (see CPLR 5501 [a]; Katz v Beil, 142 AD3d 957 [2d Dept 2016] [decided herewith]).
