Appeal from a judgment of the County Court of Schoharie County (Bartlett III, J.), rendered April 28, 1999, convicting defendant upon her plea of guilty of the crime of murder in the first degree.
Defendant entered a plea of guilty to murder in the first degree in satisfaction of a five-count indictment. Frior to sentencing, she moved to withdraw her plea on the ground that, because of her mental condition and the effects of her medication, her plea was not voluntary, knowing and intelligent. County Court denied the motion without a hearing and sentenced defendant to 25 years to life in prison in accordance with the plea agreement. On this appeal, defendant contends that her motion should have been granted or, at minimum, County Court should have conducted a hearing.
Whether a defendant should be permitted to withdraw a guilty
Crew III, Peters, Mugglin and Lahtinen, JJ., concur. Ordered that the judgment is affirmed.
