Appeal from a judgment entered September II, 1909, upon an order of the Appellate Division of the Supreme Court in the third judicial department, which reversed an interlocutory judgment of Special Term sustaining a demurrer to the complaint and directed final judgment in favor of plaintiff in an action to restrain the defendant from revoking a certificate

authorizing the plaintiff, a foreign corporation, to transact the business of life insurance in the state of New York.
