Majority

p. 716
The People of the State of New York, Respondent, v. Angelo Fazio, Appellant.
Argued March 30, 1964;
decided April 30, 1964.
p. 717
Thomas R. Beecher, Jr., for appellant.
Edward S. Silver, District Attorney (William I. Siegel of counsel), for respondent.

Order affirmed upon the ground that, unlike People v. Mangi ( 10 N Y 2d 86 ), it was not the District Attorney who prevented the accomplice witness from fully explaining his motive for offering testimony that implicated defendant in the crime for which he was convicted.

Concur: Chief Judge Desmond and Judges Dye, Fuld, Van Voorhis, Burke, Scileppi and Bergan.
