Appeal from Municipal Court, Borough of Manhattan, Sixth District. Action by Max Rogow against Benjamin Hurd. From a judgment of the Municipal Court in favor of plaintiff, defendant appeals. Reversed, and new trial ordered. Adams, Clark & Tappin (Langdon P. Marvin and Adelbert J. Smith, of counsel), for appellant. Julius D. Tobias, for respondent.

The record contains a large amount of irrelevant matter, but no evidence of any cause of action against _ the defendant. Judgment reversed, and new trial ordered, with costs to appellant to abide the event. All concur.
