No opinion. Order ( 79 Misc. Rep. 546 , 140 N. Y. Supp. 254 ) modified, by striking therefrom the provision for judgment in favor of defendant (see Ventriniglia v. Eichner, 138 App. Div. 274 , 122 N. Y. Supp. 966 ), and, as modified, affirmed, without ■costs.
