Appeal from Trial Term, New York County. Action by Gaetano •Sciacca against City of New York. From a judgment for plaintiff, defendant appeals. Reversed, and complaint dismissed. C. J. Nehrbas, of New York City, for appellant. Samuel Wechsler, of New York City, for respondent.

The evidence does not sustain the finding that the defendant was negligent. The judgment. and order appealed from are therefore reversed, with costs, and the complaint dismissed, with costs.
