Appeal from Special Term, New York County. Action by Arthur Walker & Co., Incorporated, against William Deeming. From an order denying a motion to vacate an order for examination of defendant before trial, defendant appeals. Affirmed. Chas. H. Broas, of New York City, for appellant. L. O. Van Doren, of New York City, for respondent.

The order appealed from must be modified, by striking from the order for the examination of the defendant the provision requiring the production of books and papers on such examination. As so modified, the order is affirmed, without costs.
