Action by Pierre B. Du Bois, as administrator of the goods, chattels, and credits of Emanoele Oasamola, deceased, against James Stewart & Co., Incorporated.

Order modified, by striking therefrom the provision that plaintiff recover of the defendant $10 costs of motion, and inserting in place thereof that the defendant recover of the plaintiff, as a condition of said amendment, $10 costs of the motion, and, as modified, affirmed, without costs.
