Headnote

Appeal from Oily Court of New York, Special Term. Action, by Winter D. Garrett against Locke Regulator Company. From an order of the City Court of the City of New York, granting plaintiff’s motion for a bill of particulars of defendant’s separate defense, defendant appeals. Modified and affirmed.

The order is modified, by striking therefrom the requirement to furnish the particulars mentioned in paragraph numbered 6 of the order, and also striking therefrom the requirement that the bill be verified. As modified, the order is affirmed, without costs, but with disbursements to the appellant.
