We think that the judgment should be affirmed upon the opinion of Mr. Justice Andrews, ( 19 N. Y. Supp. 16 ,) handed down upon the previous appeal in thisvaction, which opinion this court adopts for the purposes of this appeal. The judgment should be affirmed, with costs.
