Action by Aaron C. Allen against the Home Bank and others. From a judgment for plaintiff, and an order denying a new trial, defendant bank appeals. Reversed.

For the reasons stated in the opinion in Allen v. Corn Exchange Bank (decided herewith) 84 N. Y. Supp. 1001 , the judgment and order must be reversed and a new trial ordered with costs to appellant to abide the event.
