Plaintiff obtained a preliminary injunction, which was subsequently dissolved, and it appeals. For an action involving the validity of the same contract, see Armstrong v. Grant, ante, 388.
Elihu Root and Delaney Nicoll, for appellant. D. H. Peckham, D. W. Cohen, and D. J. Dean, for respondents.
The plaintiff in this action has no such rights secured to it, either by the statutes or the agreement which it has made, as entitle it to interfere with the action of the board of electrical control for the construction of the remaining subways, and no injunction at its suit is required by the circumstances. The order will therefore be affirmed, with $10 costs and disbursements.
