JOHN HIGGINS, App’lt, v. JOHN GRAUL, Resp’t.

Headnote

Appeal from a judgment in favor of the defendant entered upon the verdict of a jury rendered at the Queens county circuit.
Clarence Drew, for app’lt; J. A. Weinberg, for resp’t.

—The charge of the court was explicit and'complete.

It presented all the questions to the jury in a manner of which defendant had no ground to complain. The verdict was entirely justified by the evidence. Probably any other verdict would have been set aside as against evidence. Judgment affirmed, with costs.

Barnard, P. J., not sitting; Dykman, J., concurs.
