William H. Peters et al., App’lts, v. Winfield S. Chamberlain et al., Resp’ts.
(Supreme Court, General Term, First Department,
Filed January 16, 1891.)

Headnote

Appeal from order denying motion to vacate judgment
R. L. Harrison, for app’lt; W. N. Bayliss, for resp’t, Botsford.

The facts in this case are similar to those in the case of Freeman v. The U. S. Electric Lighting Co., decided herewith, except that the motion was denied instead of being gaanted. And for the reasons stated in that opinion the order appealed from should be reversed, with ten dollars costs and disbuasements as against the respondent Botsford, and the motion granted.

Van Brunt, P. J., and Daniels, J., concur.
