Appeal from order of the supreme court, general term, first department, reversing order of special term discharging Jennie Simon from the custody of defendant and remitting the proceeding to the special term for further action.

The orders of the special and general terms should be reversed upon the authority of the decision in the Danziger case and the prisoner remanded to the custody of the defendant.
