Aaron M. Stevens et al., Resp'ts, v. The Central National Bank of Boston and Other Certificate Holders, Impl'd, App'lts.

Headnote

Appeal from judgment in favor of plaintiffs.
Campbell & Paige (E. W. Paige, of counsel), for app’lts; Hale & Bulkley (Matthew Hale, of counsel), for resp’ts.

This case has been once before this court, 57 Hun, 499 ; 33 St. Rep., 130 , upon substantially the same facts. Upon the new trial the court in its discretion followed the judgment and opinion of the general term, and I can see no reason for differing from that decision.

The judgment appealed from should be affirmed, with costs.

Mayham, P. J., concurs; Putnam, J., not acting.
