CHARLES A. CLEGG v. THE NEW YORK NEWSPAPER UNION et al.

Headnote

Motion to dismiss appeal upon the ground that the proper printed papers have not been served.
Philip Carpenter, for motion; Wm. Ford Upson, opposed.

An inspection of the order appealed from shows that the papers read upon the motion are not recited, and consequently this court cannot determined whether the proper papers have been printed or not, and the motion must be denied without costs.

The order should be sent back to the justice making the same for resettlement.
