s. 1 — Establishment and administration of Arts Development Trust Fund

s. 1(1) — Establishment and administration of Arts Development Trust Fund

There is established a fund called the Arts Development Trust Fund.

s. 1(2) — Establishment and administration of Arts Development Trust Fund

Payments into the Arts Development Trust Fund shall be made in accordance with the Gaming Control Act.

s. 1(3) — Establishment and administration of Arts Development Trust Fund

The Minister of Finance and Treasury Board shall be the custodian of the Arts Development Trust Fund and the Arts Development Trust Fund shall be held in trust by the Minister of Finance and Treasury Board.

s. 1(4) — Establishment and administration of Arts Development Trust Fund

Payments for the purposes of section 2 shall be a charge on and payable out of the Arts Development Trust Fund.

s. 1(5) — Establishment and administration of Arts Development Trust Fund

All interest arising from the Arts Development Trust Fund shall be paid into and form part of the Arts Development Trust Fund.

s. 1(6) — Establishment and administration of Arts Development Trust Fund

The Minister of Finance and Treasury Board may invest the money in the Arts Development Trust Fund in the manner authorized by the Trustees Act and may invest in securities issued under the Provincial Loans Act.

s. 2 — Use of assets of Fund

The assets of the Arts Development Trust Fund shall be used to provide grants to individuals, arts organizations and the New Brunswick Arts Board-Conseil des arts du Nouveau-Brunswick so as to promote artistic creation and excellence in the Arts. 1990, c.A-13.1, s.2; 1998, c.24, s.1

s. 3 — Minister may provide grants

For the purposes of section 2, the Minister of Tourism, Heritage and Culture may, 1990, c.A-13.1, s.3; 1990, c.N-3.1, s.17; 1992, c.2, s.7; 1998, c.24, s.2; 1998, c.41, s.10; 2000, c.26, s.24; 2007, c.10, s.17; 2012, c.39, s.15; 2012, c.52, s.6

s. 3(a) — Minister may provide grants

(a) after consultation with the New Brunswick Arts Board-Conseil des arts du Nouveau-Brunswick or a jury established by the Board, provide grants to individuals and arts organizations, and

s. 3(b) — Minister may provide grants

(b) provide grants to the New Brunswick Arts Board-Conseil des arts du Nouveau-Brunswick.

s. 4(1) — Certification of grants

The Minister of Tourism, Heritage and Culture shall certify to the Minister of Finance and Treasury Board the amount of the grants provided under section 3.

s. 4(2) — Certification of grants

When the Minister of Tourism, Heritage and Culture certifies the amounts of the grants provided, the Minister of Finance and Treasury Board may rely on the amount so certified.
