(1) In this Regulation,
“mandatory municipal road construction standard” means an Ontario Provincial Standard Specification document in Volumes 7-8 of the Ontario Provincial Standards for Roads and Public Works that is listed in the Schedule to this Regulation. (“norme obligatoire de construction des routes municipales”)
“municipal road project” means a project for the design, evaluation or construction of a highway within a municipality’s jurisdiction and control; (“projet routier municipal”)
“OPSS.MUNI 100” means the document entitled “OPSS.MUNI 100 – OPSS MUNI General Conditions of Contract”, dated November 2024, in Volumes 7-8 of the Ontario Provincial Standards for Roads and Public Works; (“document OPSS.MUNI 100”)
All documents referred to in this Regulation are published by the Ministry of Transportation and are available on the Ministry of Transportation’s Technical Publications website.
(1) Where a municipality undertakes or causes to be undertaken a municipal road project for which the procurement process commences on or after July 1, 2027 but before July 1, 2028, the municipality shall ensure that,
the design, evaluation and construction for the municipal road project conform to every applicable mandatory municipal road construction standard; and
a contract between the municipality and a contractor for the performance of work relating to the municipal road project does not exclude, modify or substitute a provision in an applicable mandatory municipal road construction standard.
Clause (1) (b) applies despite any statement in a mandatory municipal road construction standard or OPSS.MUNI 100 allowing a contract or other document to apply different provisions than those set out in a mandatory municipal road construction standard.
(1) Where a municipality undertakes or causes to be undertaken a municipal road project for which the procurement process commences on or after July 1, 2028, the municipality shall ensure that,
the design, evaluation and construction for the municipal road project conform to every applicable mandatory municipal road construction standard; and
a contract between the municipality and a contractor for the performance of work relating to the municipal road project includes only,
provisions that are set out in OPSS.MUNI 100, and
provisions that address matters that are not addressed in OPSS.MUNI 100, but no such provision shall,
exclude, modify or substitute a provision in an applicable mandatory municipal road construction standard, or
modify or substitute a provision in OPSS.MUNI 100.
Subclause (1) (b) (i) does not require the contract to include every provision set out in OPSS.MUNI 100.
Subclause (1) (b) (ii) applies despite any statement in a mandatory municipal road construction standard or OPSS.MUNI 100 allowing a contract or other document to apply different provisions than those set out in a mandatory municipal road construction standard or OPSS.MUNI 100.
(1) Every municipality shall file with the Ministry an annual report on or before April 1 in each year, starting on April 1, 2028.
In a report described in subsection (1), the municipality shall,
list every municipal road project in the municipality in the previous calendar year that was subject to this Regulation; and
for each such project,
state the date on which the procurement process commenced,
identify every mandatory municipal road construction standard that applied to the project,
state whether the municipality complied with this Regulation, and
provide a description of any failures to comply, including the relevant provisions in the mandatory municipal road construction standard or OPSS.MUNI 100 and the reason for non-compliance.
The Minister may publish information in respect of reports required under this section.
