s. 1 — Definitions

In this Act,

s. 1 — College

“College” means the College of Dietitians of Ontario; (“Ordre”)

s. 1 — Health Professions Procedural Code

“Health Professions Procedural Code” means the Health Professions Procedural Code set out in Schedule 2 to the Regulated Health Professions Act, 1991; (“Code des professions de la santé”)

s. 1 — member

“member” means a member of the College; (“membre”)

s. 1 — profession

“profession” means the profession of dietetics; (“profession”)

s. 1 — this Act

“this Act” includes the Health Professions Procedural Code. (“la présente loi”)

s. 2 — Health Professions Procedural Code

(1) The Health Professions Procedural Code shall be deemed to be part of this Act.

s. 2(2) — Terms in Code

In the Health Professions Procedural Code as it applies in respect of this Act,

s. 2(2) — College

“College” means the College of Dietitians of Ontario; (“Ordre”)

s. 2(2) — health profession Act

“health profession Act” means this Act; (“loi sur une profession de la santé”)

s. 2(2) — profession

“profession” means the profession of dietetics; (“profession”)

s. 2(2) — regulations

“regulations” means the regulations under this Act. (“règlements”)

s. 2(3) — Definitions in Code

Definitions in the Health Professions Procedural Code apply with necessary modifications to terms in this Act.

s. 3 — Scope of practice

The practice of dietetics is the assessment of nutrition and nutritional conditions and the treatment and prevention of nutrition related disorders by nutritional means.

s. 3.1 — Authorized act

In the course of engaging in the practice of dietetics, a member is authorized, subject to the terms, conditions and limitations imposed on his or her certificate of registration, to take blood samples by skin pricking for the purpose of monitoring capillary blood readings.

s. 4 — College established

The College is established under the name College of Dietitians of Ontario in English and Ordre des diététistes de l’Ontario in French.

s. 5 — Council

(1) The Council shall be composed of,

s. 5(1)(a)

at least six and no more than nine persons who are members elected in accordance with the by-laws;

s. 5(1)(b)

at least five and no more than eight persons appointed by the Lieutenant Governor in Council who are not,

s. 5(1)(b)(i)

members,

s. 5(1)(b)(ii)

members of a College as defined in the Regulated Health Professions Act, 1991, or

s. 5(1)(b)(iii)

members of a Council as defined in the Regulated Health Professions Act, 1991. ;

s. 5(2) — Who can vote in elections

Subject to the by-laws, every member who practises or resides in Ontario and who is not in default of payment of the annual membership fee is entitled to vote in an election of members of the Council. ;

s. 6 — President and Vice-President

The Council shall have a President and Vice-President who shall be elected annually by the Council from among the Council’s members.

s. 7 — Restricted titles

(1) No person other than a member shall use the title “dietitian”, a variation or abbreviation or an equivalent in another language.

s. 7(2) — Representations of qualification, etc.

No person other than a member shall hold himself or herself out as a person who is qualified to practise in Ontario as a dietitian or in a specialty of dietetics.

s. 7(3) — Definition

In this section,

s. 7(3) — abbreviation

“abbreviation” includes an abbreviation of a variation.

s. 8

[Repealed]

s. 9 — Offence

Every person who contravenes subsection 7 (1) or (2) is guilty of an offence and on conviction is liable to a fine of not more than $25,000 for a first offence and not more than $50,000 for a second or subsequent offence.

s. 10 — Minister regulations

Subject to the approval of the Lieutenant Governor in Council, the Minister may make regulations exempting a person from subsection 7 (1) or (2) and setting conditions on such an exemption.
