Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
The Air Regulations and amendments thereto referred to in each Order in Council listed in Column I of the Schedule shall be deemed for all purposes to have been made or revoked, as the case may be, by the Minister of Transport with the approval of the Governor in Council on the date set out in Column II of the Schedule opposite the Order in Council whereby those Regulations or amendments were purportedly made, approved or revoked.
Every order, direction and document purporting to have been made or issued before the coming into force of this Act under the authority of any regulation or amendment referred to in section 1 shall be deemed for all purposes to have had the same force and effect as if it had been made or issued, on the day on which it was purported to have been made or issued, under the authority of a regulation or amendment made by the Minister of Transport with the approval of the Governor in Council pursuant to section 4 of the Aeronautics Act.
Every action and every act purporting to have been taken or performed before the coming into force of this Act under the authority of any regulation or amendment referred to in section 1 shall be deemed for all purposes to have had the same force and effect as if it had been taken or performed, on the day on which it was purported to have been taken or performed, under the authority of a regulation or amendment made by the Minister of Transport with the approval of the Governor in Council pursuant to section 4 of the Aeronautics Act.[Note: Act in force on assent June 26, 1970.]
Any proceedings before a court of competent jurisdiction that were commenced before the 27th day of May, 1970, and that were not finally disposed of before that day, in which the validity of any regulation referred to in section 1 or of any order, direction, document, action or act referred to in section 2 is in issue or has been called into question, may be dealt with and disposed of in all respects as if this Act had not come into force, but no decision, order or judgment in any such proceedings shall operate or have effect so as to render invalid, otherwise than for the purposes of those proceedings, any regulation, order, direction, document, action or act that, by virtue of section 1 or 2, would otherwise be valid.
