The Treasury Board, pursuant to paragraph 26(1)(b) of the Public Service Employment Act a, hereby makes the annexed Definition of Promotion Regulations. S.C. 2003, c. 22, ss. 12 and 13

Interpretation

In these Regulations substantive level in respect of an employee, means the occupational group and level:

at which the employee is being paid; or

if the employee has received an acting appointment, at which the employee was being paid immediately before receiving the appointment.

Application

These Regulations apply in respect of organizations named in Schedule I or IV to the Financial Administration Act.

Promotion

For the purposes of subsection 51(5) of the Public Service Employment Act, promotion means the assignment to an employee of the duties of a position for which the maximum rate of pay is more than the maximum rate applicable to the employee’s substantive level immediately before the assignment of the duties, by an amount equal to or greater than

the smallest increment on the pay scale for the new position, if it has more than one rate of pay; or

4% of the maximum rate of pay for the previous position, if the new position has only one rate of pay.

An assignment described in subsection (1) does not include the assignment of an employee to the duties of another position in the same occupational group and subgroup and at the same or a lower level.

Coming into Force

These Regulations come into force on the day on which section 12 of the Public Service Modernization Act, being chapter 22 of the Statutes of Canada, 2003, comes into force.[Note: Regulations in force December 31, 2005, see SI/2005-122.]
