Reasons for Judgment — McLachlin C.J. (LeBel, Deschamps, Fish, Abella, Rothstein, Cromwell, Moldaver and Karakatsanis JJ. concurring)

The Chief Justice — We are all of the view that the appeal should be allowed for the reasons set out by MacPherson J.A. at paras. 178-89 of his dissenting judgment (2010 ONCA 869, 272 O.A.C. 130).
The appeal is allowed and the conviction for first degree murder restored.
