L’Heureux-Dubé J. -- We are all of the view that this appeal as of right should be allowed.

We find no reversible error in the decision of the President of the Standing Court Martial and accordingly the appeal is allowed, the judgment of the Court Martial Appeal Court is set aside and the Order of the President issuing a stay is restored.
