    Regulations made under this section may apply, if they so state, to any ship as defined in Part XV but no regulation made under paragraph (1)(d) shall apply to ships capable of engaging in the drilling for, or the production, conservation or processing of, oil or gas unless that regulation so states and was made on the joint recommendation of the Minister and the Minister of Natural Resources.
